Welcome to Phylaté Studio. These Terms & Conditions are designed to maintain a safe, respectful, professional, and welcoming environment while clearly communicating the policies associated with purchasing and participating in services offered by Phylaté Studio.
By purchasing a class, class package, membership, private session, event, or other service offered by Phylaté Studio, and/or by participating in any Phylaté Studio activity, you acknowledge that you have reviewed and agree to comply with these Terms & Conditions, applicable studio policies, and any required participation waiver.
1. Eligibility & Participation
Participation in Phylaté Studio classes and services is voluntary.
Participants are responsible for determining whether they are physically able to participate safely. Each participant is expected to follow instructor directions, exercise within her own abilities, and immediately stop any movement that causes unusual pain, dizziness, shortness of breath, weakness, nausea, or other concerning symptoms.
Phylaté Studio reserves the right to modify, limit, postpone, or decline an individual’s participation when the instructor reasonably believes continued participation may present a safety concern.
Participation in any class is also subject to completion of all required waivers and forms.
2. Health Conditions, Injuries, Pregnancy & Medical Clearance
Participants are responsible for informing the instructor before class begins of any known injury, pregnancy, recent surgery, physical limitation, medical condition, change in health status, or other circumstance that could reasonably affect safe participation.
This includes, but is not limited to, cardiovascular conditions, high or low blood pressure, dizziness or fainting, recent surgery, musculoskeletal injuries, pregnancy or postpartum considerations, and any condition for which exercise restrictions have been provided.
Participants should follow the recommendations and restrictions provided by their physician or other qualified healthcare provider.
Phylaté Studio may recommend modifications or decline participation when appropriate for safety. When circumstances warrant, Phylaté Studio may request medical clearance before allowing participation or continued participation.
Failure to disclose a known condition, restriction, injury, pregnancy, or other relevant health information may limit the instructor’s ability to provide appropriate modifications.
3. Fitness & Wellness Services — Not Medical Treatment
Unless expressly provided as a separately identified licensed healthcare service, Phylaté Studio Pilates classes, group fitness services, wellness programming, educational content, and related instruction are provided for fitness, movement, wellness, and educational purposes.
Participation in a Pilates class does not establish a patient-provider relationship and is not a substitute for individualized medical diagnosis, physical therapy evaluation, treatment, or advice from a participant’s physician or other licensed healthcare provider.
Participants should seek appropriate medical care for symptoms, injuries, diagnoses, or health concerns requiring medical assessment or treatment.
4. Assumption of Risk & Required Waiver
Physical exercise, Pilates, reformer Pilates, stretching, resistance training, balance activities, and related movement inherently involve certain risks.
These risks may include, among other things, falls, muscle soreness, strains, sprains, aggravation of an existing condition, equipment-related injury, dizziness, cardiovascular events, and other foreseeable or unforeseeable injuries associated with physical activity.
Participation is voluntary.
Every participant must complete and sign Phylaté Studio’s separate Participation, Assumption of Risk & Liability Waiver before participating in class.
The waiver contains additional provisions concerning assumption of risk, release of claims, responsibilities of the participant, and other liability matters.
Nothing in these Terms & Conditions or the separate waiver is intended to waive any right or liability that cannot legally be waived under applicable law.
5. Instructor Directions & Modifications
Participants agree to follow reasonable safety instructions provided by Phylaté Studio instructors.
Modifications may be recommended based on pregnancy, injury, physical ability, experience, equipment availability, or other safety considerations.
Participants should never perform an exercise contrary to restrictions provided by their healthcare provider.
An instructor may ask a participant to discontinue a particular movement or stop participating in a class if the instructor reasonably believes continuation could create a safety risk.
6. Grip Socks, Mats & Studio Safety
Pilates grip socks are required for participation in all Phylaté Studio classes.
Participants who arrive without appropriate grip socks may be required to obtain appropriate socks before participating or may be denied participation in the class when necessary for safety.
Participants may bring their own Pilates or exercise mat. Mats may also be provided by the studio when available.
Participants agree to use studio equipment only as instructed and to refrain from operating, adjusting, climbing on, or otherwise using reformers or other equipment outside of instructor direction.
7. Class Reservations
Advance reservations are required unless otherwise stated.
All reservations are subject to availability.
Purchasing a package or unlimited membership does not guarantee availability in any particular class, date, instructor, or time slot.
Participants are responsible for booking their own classes through the studio’s designated scheduling system unless otherwise arranged.
8. Arrival & Late Entry
Participants should arrive on time and ready to begin at the scheduled class time.
Participants arriving more than 10 minutes after the scheduled start time will not be permitted to enter the class.
This policy exists because warm-up, equipment setup, safety instructions, and foundational movement instruction may already have occurred.
Being denied entry due to late arrival is considered a late cancellation/no-show for purposes of the applicable package or membership policy.
9. Cancellation & Rescheduling
Participants must cancel or reschedule a class at least 12 hours before the scheduled start time to retain the applicable class credit.
A cancellation made less than 12 hours before class may result in forfeiture of that class credit.
For single-class purchases, a late cancellation or no-show may result in forfeiture of the amount paid for that reservation.
Emergencies happen. Requests for exceptions due to genuine emergencies will be reviewed individually and are granted solely at the discretion of Phylaté Studio, except where otherwise required by applicable law.
An exception granted on one occasion does not require Phylaté Studio to grant the same or similar exception in the future.
10. No-Shows
A participant who reserves a class and does not attend without timely cancellation will be considered a no-show.
For class-pack participants, the reserved class will be deducted from the package.
For single-class participants, the class purchase will be forfeited.
Because studio and reformer capacity is limited, reserving a space and failing to attend prevents another participant from using that space.
11. Unlimited Membership No-Show Policy
“Unlimited” refers to eligible class access during the applicable membership period and does not mean unlimited missed reservations.
Unlimited members are expected to cancel reservations they cannot attend within the required cancellation period.
Repeated late cancellations or no-shows may result in restrictions on advance booking privileges.
Three or more no-shows within a rolling 30-day period may result in temporary booking restrictions, suspension, or termination of membership at the discretion of Phylaté Studio.
Phylaté Studio reserves discretion to consider genuine emergencies and unusual circumstances.
12. Class Packages & Expiration
Unless otherwise expressly stated at purchase, class packs are valid for 30 days from the date of purchase or activation specified by the studio.
Unused classes expire at the conclusion of the applicable period.
Unused class credits do not roll over into another package period.
Participants are responsible for scheduling and using purchased classes before expiration.
Failure to schedule available classes during the applicable period does not automatically extend the package.
Extensions may be granted only when expressly approved by Phylaté Studio or when required by applicable law.
13. Individual Use & Transfers
Class packages and memberships are purchased for the individual identified at purchase.
Packages, memberships, and class credits may not be shared, sold, transferred, divided between individuals, or gifted after activation unless Phylaté Studio expressly authorizes the transfer.
A participant may not use multiple credits from her package to admit another participant unless specifically permitted by the studio.
14. Payments & Refunds
All payments are due at the time required by the applicable purchase or membership arrangement.
Except where otherwise required by applicable law or expressly stated by Phylaté Studio, purchases are final and non-refundable.
Failure to attend, failure to use all purchased classes before expiration, scheduling conflicts, personal preference, or voluntary discontinuation does not ordinarily entitle the purchaser to a refund.
Nothing in this policy eliminates cancellation or refund rights that a purchaser may have under applicable federal, state, or local law.
15. Membership Billing & Cancellation
The specific price, billing schedule, membership period, renewal terms, cancellation process, and any founding-member or promotional pricing applicable to a membership will be disclosed at purchase.
Where recurring billing applies, the participant authorizes the applicable payment method to be charged according to the membership terms accepted at enrollment.
Any cancellation request must comply with the cancellation procedure applicable to that membership and with applicable law.
Cancellation of future membership billing does not automatically create a right to reimbursement for services already provided or periods already used, except where required by law.
16. Founding Member & Promotional Rates
Founding Member, introductory, promotional, discounted, or specially negotiated rates may be subject to separate eligibility requirements and conditions.
Where a Founding Member rate is conditioned upon continuous membership, cancellation or lapse of that membership may result in permanent loss of the special rate. A participant who later rejoins may be required to enroll at the then-current public rate.
Promotional pricing does not guarantee that the same promotion or rate will be offered in the future.
17. Instructor Substitutions
Registration for a class reserves participation in the class, not a guarantee of instruction by a particular instructor.
Phylaté Studio expressly reserves the right to substitute another appropriately qualified instructor at any time when necessary due to illness, scheduling, emergency, professional obligations, staffing needs, or other circumstances.
An instructor substitution does not, by itself, entitle a participant to a refund.
18. Class Changes & Studio Cancellations
Phylaté Studio reserves the right to modify class schedules, class formats, instructors, or locations when reasonably necessary.
If Phylaté Studio cancels an individual class, affected participants will ordinarily be provided an opportunity to reschedule the affected class or receive an equivalent class credit, rather than a cash refund, except where a refund is required by applicable law.
Any replacement class or credit will be subject to availability.
Phylaté Studio will make reasonable efforts to communicate cancellations and significant scheduling changes as promptly as circumstances permit.
19. Weather, Emergencies & Events Beyond Studio Control
Classes may be delayed, modified, relocated, or canceled because of severe weather, unsafe road conditions, power outages, building issues, emergencies, government orders, natural disasters, or other circumstances beyond the reasonable control of Phylaté Studio.
When reasonably possible, affected reservations will be rescheduled or credited according to studio policy and applicable law.
Participant safety will take priority when determining whether a class should proceed.
20. Respectful Conduct & Community Standards
Phylaté Studio is committed to maintaining a safe, welcoming, respectful, supportive, and inclusive environment for women participating in studio programming.
Harassment, bullying, intimidation, threats, unwanted physical contact, discriminatory or derogatory comments, sexually inappropriate behavior, deliberate disruption, aggressive conduct, or disrespect toward another participant, instructor, guest, employee, contractor, or facility representative will not be tolerated.
Participants are expected to respect personal boundaries, studio property, equipment, instructors, and one another.
21. Right to Refuse or Discontinue Service
Phylaté Studio reserves the right, to the extent permitted by applicable law, to refuse, suspend, or discontinue service when reasonably necessary to protect safety, enforce studio policies, prevent harassment or disruption, address nonpayment or misuse of services, or protect the studio community.
Serious misconduct may result in immediate removal from the premises and/or termination of participation privileges.
Repeated policy violations may result in suspension or termination of membership or future booking privileges.
Any refund or account adjustment associated with termination will be handled in accordance with the participant’s agreement and applicable law.
22. Equipment & Property
Participants must use reformers, props, mats, and other studio equipment only for their intended purposes and according to instructor direction.
Intentional, reckless, or unauthorized misuse of equipment is prohibited.
Participants may be held financially responsible, to the extent permitted by law, for damage caused by intentional misconduct or improper use outside instructor direction.
Phylaté Studio is not responsible for lost, stolen, forgotten, or damaged personal belongings to the extent permitted by law. Participants should keep valuable belongings secure.
23. Personal Devices & Class Disruption
Phones and other personal devices should be silenced during class unless an accommodation or emergency requires otherwise.
Recording, photographing, livestreaming, or otherwise capturing another participant without permission is prohibited.
Participants should avoid conduct that unnecessarily disrupts instruction or interferes with another participant’s ability to enjoy class.
24. Photography & Social Media
Phylaté Studio may occasionally photograph or record studio activities for marketing, educational, or social-media purposes.
Where an individual’s identifiable image is intended to be used for promotional purposes, appropriate consent will be obtained as required.
Participants may notify the studio if they do not wish to appear in photographs or recordings.
A participant’s refusal to consent to promotional photography will not, by itself, prevent her from participating in ordinary classes.
25. Private Sessions, Wellness Services & Deposits
Private Pilates sessions, one-on-one wellness services, assessments, workshops, events, or other specialty services may have separate pricing, deposit requirements, cancellation periods, or policies disclosed at booking.
Where a deposit is required, the applicable booking page or service agreement will identify whether that deposit is refundable, transferable, or applicable toward the final service price.
Terms specific to an individual service supplement these general Terms & Conditions.
26. Changes to Schedule, Pricing & Offerings
Phylaté Studio may modify future schedules, class offerings, package structures, operating hours, instructors, or pricing.
Price changes will not retroactively alter a completed one-time purchase unless expressly agreed upon.
Membership pricing changes will be handled according to the applicable membership agreement, notice requirements, and applicable law.
27. Policies May Be Updated
Phylaté Studio reserves the right to revise these Terms & Conditions and studio policies as the business, services, or legal requirements evolve.
The most current version will be made available through the studio website or other designated location.
Material changes affecting an existing membership will be handled according to the applicable membership agreement and applicable law.
28. Compliance With Applicable Law
These Terms & Conditions are intended to operate consistently with applicable federal, state, and local law.
If any provision conflicts with a legal right that cannot lawfully be waived or restricted, applicable law will control.
If one provision is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
29. Participant Responsibility
Each participant is responsible for:
Providing accurate information during registration.
Completing required forms and waivers.
Disclosing information relevant to safe exercise participation.
Following applicable medical restrictions.
Arriving on time.
Wearing required grip socks.
Using equipment appropriately.
Managing reservations and cancellations.
Monitoring package expiration dates.
Treating instructors and fellow participants respectfully.
Asking questions when an instruction or movement is unclear.
Stopping exercise and informing the instructor when experiencing concerning symptoms.
30. Acknowledgment
By purchasing, reserving, or participating in a Phylaté Studio service, the participant acknowledges that she has had the opportunity to review the applicable policies and agrees to comply with them.
Participation remains subject to completion of any required Participation, Assumption of Risk & Liability Waiver and any membership or service-specific agreement.
Phylaté Studio reserves all rights available to it under applicable law.
Photography, Recording & Participant Privacy
Phylaté Studio is committed to protecting the privacy, comfort, and dignity of every woman who enters the studio. Participants have the right to attend class without being photographed, filmed, livestreamed, or posted publicly without their knowledge and consent.
Personal Photography & Recording
Participants may photograph or record themselves only, provided that doing so does not disrupt class or capture another participant in the foreground or background.
Participants wishing to create personal or social media content may be asked to use a designated filming area or position, such as the rear of the studio, where the camera can be directed solely toward themselves.
Participants may not photograph, film, livestream, or otherwise record another participant without that individual’s express permission.
The privacy of other participants takes priority over an individual’s desire to create content. Phylaté Studio reserves the right to require any photography or recording to stop immediately if it interferes with class, compromises another participant’s privacy, or creates an uncomfortable or disruptive environment.
Phylaté Studio Live & Virtual Classes
Certain Phylaté Studio classes may occasionally be livestreamed or recorded for virtual participants, educational programming, or other studio services.
When a class is being livestreamed or recorded, participants will be informed. The camera will be positioned and framed with the intention of capturing the instructor only, not class participants.
Because these sessions occur in a live group environment, participant voices, questions, laughter, or other incidental background audio may occasionally be heard during a livestream or recording. Participants acknowledge this possibility when choosing to attend a class designated as a live or recorded session.
Phylaté Studio will make reasonable efforts to prevent participants from being visually captured during instructor-focused livestreams or recordings.
Studio Marketing & Promotional Content
Participation in a regular Phylaté Studio class does not automatically constitute consent for an individual’s identifiable image or likeness to be used for studio marketing or promotional purposes.
When Phylaté Studio wishes to intentionally photograph or record participants for social media, advertising, website content, promotional materials, or similar purposes, appropriate permission or consent will be obtained.
Participants who do not wish to appear in promotional photographs or recordings may decline without affecting their ability to participate in regular studio classes.
Respecting Our Community
Many women enter Phylaté Studio during personal and sometimes vulnerable seasons of their wellness journeys. For this reason, participant privacy is treated as an important part of maintaining a safe and respectful studio environment.
Unauthorized recording, repeated disregard of another participant’s privacy, or refusal to comply with an instructor’s direction regarding photography or recording may result in removal from class, restriction of studio privileges, or additional action under Phylaté Studio’s conduct policies.

LIABILITY WAIVER, ASSUMPTION OF RISK & PARTICIPANT ACKNOWLEDGMENT
Phylaté Studio Pelvic Health + Pilates
By participating in classes, sessions, programs, or other services offered by Phylaté Studio Pelvic Health + Pilates (“Phylaté Studio”), I acknowledge and agree to the following:
1. Voluntary Participation & Assumption of Risk
I understand that Pilates, Reformer Pilates, mat-based exercise, pelvic-health-focused exercise, stretching, mobility work, strength and conditioning activities, and other forms of physical activity involve inherent risks.
These risks may include, but are not limited to, muscle soreness, strains, sprains, falls, loss of balance, aggravation of a previous injury or condition, and other injuries that may occur during physical activity or while using Pilates or exercise equipment.
I voluntarily choose to participate in these activities and knowingly accept the inherent risks associated with my participation.
2. Reformer & Equipment Use
I understand that Phylaté Studio may use Pilates Reformers and other exercise equipment, including springs, straps, footbars, boxes, resistance equipment, props, and accessories.
I agree to use all equipment only as instructed and to follow all safety directions provided by the instructor. I will not adjust, operate, mount, dismount, or use equipment in a manner contrary to the instructor's directions.
I understand that failure to follow instructions or equipment safety procedures may increase my risk of injury.
3. Health & Medical Disclosure
I understand that it is my responsibility to disclose any information that may affect my ability to participate safely, including current or previous injuries, pain, surgeries, pregnancy, postpartum status, medical conditions, physical limitations, movement restrictions, or healthcare-provider-imposed restrictions.
I agree to notify my instructor of any relevant change in my health or physical condition before participating in subsequent sessions.
I understand that Phylaté Studio services are not a substitute for medical diagnosis, treatment, or emergency medical care. I understand that I may be advised to obtain medical clearance before participating when appropriate.
4. Pregnancy & Postpartum Participation
If I am pregnant, believe I may be pregnant, or am postpartum, I agree to inform my instructor before participating.
I understand that pregnancy and postpartum recovery may require modifications to exercise and that my needs and abilities may change throughout pregnancy and recovery. I agree to communicate discomfort, symptoms, restrictions, or concerns promptly and to follow recommendations from my healthcare provider regarding participation in physical activity.
5. Personal Responsibility & Communication
I understand that I am responsible for monitoring my own body during participation.
I agree to immediately inform my instructor if I experience pain, dizziness, shortness of breath beyond what I would reasonably expect from exercise, unusual pressure, bleeding, leakage, significant discomfort, or any other symptom that concerns me.
I understand that I have the right to stop an exercise or end my participation at any time.
6. Modifications & Instructor Direction
I understand that instructors may provide modifications, corrections, cues, or alternative exercises based on safety, ability, disclosed conditions, or observed movement.
I agree to follow instructor directions and understand that an instructor may modify, restrict, or discontinue my participation in an exercise or session when the instructor reasonably believes doing so is necessary for safety.
7. Release & Assumption of Liability
To the fullest extent permitted by applicable law, I voluntarily assume the inherent risks associated with participating in Phylaté Studio activities and agree to release and hold harmless Phylaté Studio Pelvic Health + Pilates, its owner, instructors, employees, contractors, and representatives from claims arising from the ordinary and inherent risks of my voluntary participation, except to the extent that liability cannot legally be waived or limited.
I understand that this acknowledgment does not waive any rights that cannot legally be waived under applicable law.
8. Participant Acknowledgment
By accepting this agreement, I confirm that:
I have read and understand this Liability Waiver, Assumption of Risk & Participant Acknowledgment.
I have had the opportunity to ask questions before participating.
I understand the nature of the activities in which I am choosing to participate.
I accept responsibility for communicating relevant health information and physical limitations.
I understand that participation is voluntary.
I knowingly accept the inherent risks associated with participation.
I agree to follow instructor instructions and studio safety procedures.
I understand that I may stop participating at any time.
By electronically accepting this agreement, I acknowledge that my electronic acceptance is intended to serve as my acknowledgment and agreement to these terms.

FAQs
Can I get a refund for a class, package, or membership?

All purchases are non-refundable except where otherwise required by applicable law. Please review package expiration dates, cancellation requirements, and membership terms carefully before purchasing.
What happens if I need to cancel or miss a class?

Classes must be canceled or rescheduled at least 12 hours before the scheduled start time to retain your class credit. Late cancellations and no-shows may result in forfeiture of the class credit, with emergency exceptions considered at Phylaté Studio’s discretion.
What happens if Phylaté Studio cancels my class?

If Phylaté Studio must cancel a class, your class will not be lost. You will be given the opportunity to reschedule or receive an equivalent class credit for another available session, subject to studio policies and applicable law.
Can I take pictures or record during class?

You may record yourself only when permitted and when no other participant appears in your photo or video. Participant privacy comes first, and Phylaté Studio may require filming to stop or be moved to a designated area at any time.
